This Privacy Statement applies to Nix Hydra Games, Inc. ("Nix Hydra", "we", "our", or "us") and governs personal information we collect online from users of our website located at www.nixhydra.com (the "Site") and from people that play our games that link to this Privacy Statement, including The Arcana, FictIf, Egg Baby, Egg!, or other Nix Hydra games or products (collectively "Games") (collectively, "you").
For the purposes of this Privacy Statement, "Corporate Affiliates" means any entity or joint venture that is wholly or partially owned or controlled by Nix Hydra, or under common corporate control with Nix Hydra. "Service Providers" means any subcontractor, vendor, or other entity with whom we have an ongoing business relationship for them to provide us with products, services, or information. "Personal Information" means information which identifies, or could be used to identify, you.
Information We Collect
We collect information about you, including identifiers, internet or other browsing activity, and commercial information, in the following ways:
Information we receive directly from you, which includes information you provide in:
Registering and playing our Games — when you download and play The Arcana or FictIf, you have the option of registering as a guest or registering through your Facebook or Gmail account. When you register as a guest, your device is assigned a unique identifier but we do not otherwise collect any other specific identifiers about you. When you register through your Facebook or Gmail account, we receive a unique identifier provided by Facebook or Gmail and you also have the option to share other identifiers such as your name, email address, language preference, and profile picture with us. You are not required to register to play our other Games. We may also collect your in-game purchase history and login history when you play our Games.
Making a purchase — If you place an order or make a purchase from our Site, we collect information about the purchase including product, name, and shipping address but we do not collect your credit or payment information. Payment processing is handled by our Service Provider(s).
Contacting us — When you contact us, for example for technical or other support, we may ask you for information on the nature of your issue (such as which product you are using or which purchase you have made) and any other information pertinent to the support request.
Completing a survey — From time to time, we ask users of our Games to complete surveys. We will collect your email address and survey responses. We may also collect your name if you choose to provide it to us.
Information we receive indirectly from you, which includes information sent by your device or browser when you visit our Site or play our Games. We, and sometimes third parties on our behalf, collect technical information including IP addresses, device type, device identifiers, browser types, browser language, referring and exit pages, platform type, the number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, search terms used, game state and the date and time of activity in our Games, and other similar information. This information is collected through tracking tools that include web beacons, cookies, log files, other persistent advertising identifiers (such as IDFA on iOS devices and advertising ID on Android devices) and other technologies. We also use third party analytics services to analyze how a visitor uses the Site or interacts with our Games. How We Use Your Personal Information
Nix Hydra and its Service Providers use Personal Information and technical information for various purposes, such as the following:
✦ To send communications to you, such as your transactions status (for example, order confirmations), as well as information about products and services available from Nix Hydra and its Corporate Affiliates, promotional offers, and other communications.
✦ To provide products and services you have requested, including for billing and shipping purposes to process your orders.
✦ To customize, analyze, and improve our Games and other products and services.
✦ To enforce our conditions of sale, website terms and/or separate contracts (if applicable) with you.
✦ To prevent fraud and other prohibited or illegal activities.
✦ For any other lawful purpose consistent with this Privacy Statement.
Nix Hydra's Games include various social features. If you elect to participate in those features, certain information about you will be available to other players of the Games, including your user name, game name, customization of game features, activities and achievements relating to the Games, the times and lengths of time that you progress on your in-game item, and the identities of persons you identify as friends and of persons that identify you as a friend. The Site also allows you to provide comments in various sections of the Site, such as our blog. The information you post in these areas may be available to other users of the Site and the general public.
We may share your Personal Information, including identifiers, internet or other similar network activity, and commercial information with others for a business purpose. The categories of third parties with whom we share this information include our Corporate Affiliates and Service Providers that perform activities on our behalf. We may also disclose your Personal Information in connection with law enforcement, fraud prevention, or other legal action; as required by law or regulation; or if Nix Hydra reasonably believes it is necessary to protect Nix Hydra, its customers, or the public.
We do not sell, or share for other valuable consideration, information about you to third parties.
As we continue to develop our business, we might sell or buy products, subsidiaries, or business units. In such transactions, customer information generally is one of the transferred business assets. In the event that Nix Hydra, or all or a portion of its assets are acquired, or Nix Hydra experiences any change of control transaction (including bankruptcy), customer information including your Personal Information will be one of the transferred assets.
We may share de-identified or aggregated user information, without limitation.
How We Secure Your Personal Information
Nix Hydra uses reasonable precautions to help protect your Personal Information from unauthorized access, use, or disclosure. While we strive to protect your Personal Information, Nix Hydra cannot ensure or warrant that the Personal Information or private communications you transmit to us will always remain private.
If you are visiting the Site from a location outside the United States, please note that you are transferring your Personal Information to Nix Hydra for storage in the United States or other countries where Nix Hydra stores Personal Information. By providing your Personal Information, you consent to such transfer and storage of Personal Information in the United States (or any other country where such Personal Information may be stored).
The Site and Games are not intended for children under 13. If you are under 13 years of age, please do not submit any Personal Information to us without the express consent and participation of a parent or guardian.
We, or our Service Providers, may use web beacons on our Site, in our e-mails, in our advertisements on other websites, or in our advertisements in others’ e-mails. A web beacon is an electronic image that can be used to recognize a cookie on your device when you view a web page or e-mail. Web beacons help us measure the effectiveness of our Site and our advertising in various ways, for example, by counting the number of individuals who visit our Site from a particular advertisement or make a purchase from our Site after viewing a particular advertisement as well as by telling us when a web page is viewed and providing a description of the page where the web beacon is placed. Web beacons also help us measure the effectiveness of our e-mail campaigns, for example, by counting the number of individuals who open or act upon an e-mail message, determining when an e-mail message is opened and determining how many times an e-mail message is forwarded.
The information we collect may include some limited Personal Information, such as identifiers or information about internet or other similar network activity, and web beacons allow us to recognize users by accessing Nix Hydra cookies. We may also combine the information that we collect through web beacons with other Personal Information we have collected from you.
We may collect or allow third parties to collect aggregated or statistical information using web beacons for analytics purposes, such as by allowing such third parties to develop statistics on how often clicking on an advertisement results in a purchase or other action. Aggregate information is anonymous and may include demographic and usage information. You can make some – but not all – web beacons unusable by rejecting cookies.
Third-Party Links and Social Networking
Please be aware that other websites or mobile apps offered by third parties that may be accessed through our Site or the Games may collect Personal Information about you. The information practices of those third-party websites or third-party mobile apps linked to or from the Site or the Games are not covered by this Privacy Statement. We recommend that you review the privacy statements of other entities with which you interact.
The Site and Games may also include integrated social media tools or "plug-ins", such as social networking tools offered by third parties. If you use these tools to share Personal Information or you otherwise interact with social media features on the Site or Games, those social media companies may collect information about you and may use and share such information in accordance with your account settings, including by sharing such information with the general public. Your interactions with third-party social media companies and the use of their features are governed by the privacy policies of the social media companies that provide those features. We encourage you to carefully read the privacy policies of any social media accounts you create and use.
Digital Advertising and Analytics
We may partner with third-party ad networks and other ad-serving providers (“Advertising Providers”) that serve ads on our behalf and others’ on non-affiliated platforms. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of the Site and the Games and other sites or apps over time, including information about relationships among different browsers and devices. This type of advertising is known as interest-based advertising.
You can opt out of receiving interest-based ads for web properties here (Digital Advertising Alliance’s WebChoices) or for mobile apps here (Digital Advertising Alliance’s AppChoices). If you delete your cookies, reset your device advertising identifier, or use a different browser or mobile device, you will need to renew your opt-out choice. You may also be able to limit data collection for advertising purposes using tools available on your device. Note that electing to opt out will not stop advertising from appearing in your browser. It may make the ads you see less relevant to your interests. Even if you opt out, Advertising Providers may continue to collect data for other purposes, including analytics and other operational purposes.
Advertising Providers may also collect and use information through our apps about the precise location of your mobile device, in order to provide ads that are more relevant to you. If you do not want Advertising Providers to collect information through our apps about your device’s precise location, you can turn off location services on your device.
We may also work with third parties that collect data about your use of the Site and the Games and other sites or apps over time for non-advertising purposes. Nix Hydra uses third-party services to improve the performance of the Site and the Games and for analytics and marketing purposes.
To opt out of our e-mail marketing, you can use the link provided at the bottom of each marketing message.
In the Settings of The Arcana, you can select Unity Data Privacy, which directs you to a web page to manage your privacy settings, including to request a copy of your data or to opt-out of a personalized game experience.

The terms and conditions contained in this section – Notice to European Residents – EU Specific Terms – applies only to the Personal Information of European Union residents we may process.

Nix Hydra will only process your information where we have a legal basis to do so. The legal basis will depend on the reason(s) Nix Hydra collected and needs to use your Personal Information. The different legal bases we rely on are:
